Terms and conditions of service

These Terms and Conditions ("Terms") govern your participation in retreats and custom trips ("Trips") operated by Sip Sip Getaway, a trading name of Bamboe Services, registered in the Netherlands.

By booking a Trip with us, you acknowledge that you have read, understood, and agree to be bound by these Terms.

We offer gastronomy and wine retreats in Croatia, as well as custom trips focused on exploring regional cuisine and wines.

2. BOOKING & PAYMENT

2.1 How to Book

Bookings can be made by contacting us via email or through our website. Your booking is confirmed only when:

  • You have paid the required deposit

  • We have sent you written confirmation

2.2 Deposit

A non-refundable deposit of 30% of the total trip price per person is required to secure your booking.

2.3 Final Payment

The remaining balance (70%) is due 30 days prior to the Trip departure date.

2.4 Payment Methods

We only accept bank transfers. All prices are in Euros (EUR).

2.5 Minimum Participants

Each Trip requires a minimum of 4 participants with private rooms booked. If this minimum is not met, we reserve the right to cancel the Trip (see Section 5).

2.6 Maximum Participants

Currently, we accommodate up to 10 participants per Trip. This may increase as we expand our offerings.

3. WHAT'S INCLUDED IN THE PRICE

For each getaway, a detailed itinerary is provided, with items included in the price, as well as those not included clearly listed.

3.1. ARRIVAL AND DEPARTURE TIMES

3A.1 Check-In and Check-Out

  • Earliest arrival time: 11:00h in the morning on the arrival day

  • Latest departure time: 10:00h in the morning on the departure day

Earlier arrivals and later departures are not possible due to property management and cleaning schedules.

3.2 Guest Registration (Croatian Legal Requirement)

All guests are required by Croatian law to provide official identification documents for tourist registration with the Croatian National Tourist Board (HTZ).

You must present one of the following upon arrival:

  • Valid passport

  • Valid national ID card (EU citizens)

This information will be used solely for mandatory tourist registration purposes and will be handled in accordance with Croatian law and GDPR.

Failure to provide valid identification may result in being denied access to the property, with no refund of the trip price.

4. WHAT'S NOT INCLUDED IN THE PRICE

International airfare to/from Croatia

❌ Food and drinks consumed outside the planned program

❌ Alcoholic beverages during free time or meals not specified above

❌ Personal expenses (souvenirs, tips, etc.)

❌ Travel insurance (strongly recommended - see Section 11)

❌ Visa fees (if applicable)

❌ Any activities not explicitly listed in the itinerary

5. CANCELLATION & REFUND POLICY (BY PARTICIPANT)

5.1 Deposit

The 30% deposit is non-refundable under all circumstances.

5.2 Cancellation Timeline

If you need to cancel, please contact us immediately. Cancellations are subject to the following terms:

  • Between 120-90 days before departure: Refund of 70% of trip price (deposit remains non-refundable)

  • Between 90-45 days before departure: Refund of 50% of trip price (deposit remains non-refundable)

  • Less than 45-30 days before departure: Refund of 40% of the trip price (deposit remains non-refundable)

  • Less than 30 days before departure: No refund; the full trip price is forfeited

5.3 How to Cancel

All cancellations must be submitted in writing (email) and are effective on the date we receive your cancellation notice.

5.4 No-Show

If you fail to appear for the Trip without prior cancellation, the full trip price is forfeited and no refund will be issued.

5.5 Transferring Your Booking

You may transfer your booking to another person provided that:

  • The replacement person meets all eligibility requirements (age, health, etc.)

  • You notify us in writing at least 15 days before departure

  • The replacement person accepts these Terms and Conditions

  • There is no difference in pricing (if there is, the difference must be paid)

6. TRIP CHANGES & CANCELLATION BY SIP SIP GETAWAY

6.1 Cancellation Due to Minimum Participants

If we do not reach the minimum of 4 participants, we reserve the right to cancel the Trip. In this case:

  • You will be notified at least 60 days before departure

  • You will receive a full refund (including deposit), OR

  • You may apply the full amount as credit toward another Trip within 12 months

6.2 Cancellation by Us for Other Reasons

We may cancel a Trip due to circumstances beyond our control (see Section 7). In such cases, you will receive:

  • Credit toward a future Trip of equal or greater value

6.3 Itinerary Changes

We reserve the right to modify the itinerary, including:

  • Substituting wineries, restaurants, or other venues

  • Adjusting timing or schedule

  • Changing activities due to weather, availability, or unforeseen circumstances

We will make reasonable efforts to provide equivalent alternatives. Minor changes do not entitle you to a refund. Significant changes will be communicated as soon as possible.

7. FORCE MAJEURE

We are not liable for failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters, such as earthquakes, floods, fires

  • Severe weather conditions

  • Pandemics, epidemics, or health emergencies

  • War, terrorism, civil unrest, or political instability

  • Government restrictions or travel bans

  • Strikes or labor disputes

  • Closure of wineries, restaurants, or other third-party venues

In such cases, we will work with you to reschedule or provide credit to a future trip, or a refund if required by applicable consumer protection laws. We are not obligated to provide refunds beyond what we can recover from third-party vendors.

This is why we strongly recommend travel insurance (see Section 11).

8. AGE REQUIREMENT & ALCOHOL POLICY

8.1 Minimum Age

All participants must be at least 18 years of age at the time of the Trip. We reserve the right to request valid identification.

8.2 Alcohol Service

Our Trips include wine tastings and meals where alcohol is served. By booking, you acknowledge:

  • Alcohol will be present and served

  • You are responsible for your own alcohol consumption

  • We reserve the right to refuse alcohol service to anyone at our discretion

  • You will consume alcohol responsibly and not to the point of intoxication

8.3 Intoxication & Disruptive Behavior

We have zero tolerance for:

  • Intoxication that endangers yourself or others

  • Drunk and disorderly conduct

  • Harassment, discrimination, or abusive behavior

  • Damage to property

We reserve the right to remove any participant from the Trip immediately without refund if their behavior is deemed inappropriate, dangerous, or disruptive (see Section 16).

9. HEALTH, SAFETY & FITNESS REQUIREMENTS

9.1 Physical Fitness

Our Trips involve:

  • Walking on uneven terrain (vineyards, cobblestones)

  • Stairs (at accommodations and venues)

  • Outdoor activities in varying weather

You must be in reasonable physical health to participate. If you have concerns about your fitness level, please contact us before booking.

9.2 Food Allergies & Dietary Restrictions

YOU MUST DISCLOSE ALL FOOD ALLERGIES AND DIETARY RESTRICTIONS AT THE TIME OF BOOKING.

While we will make reasonable efforts to accommodate your needs:

  • We cannot guarantee allergen-free environments at third-party venues

  • Cross-contamination may occur

  • You are responsible for managing your own allergies and dietary needs

  • We are not liable for allergic reactions or dietary issues

9.3 Medical Conditions

You must inform us of any medical conditions that may:

  • Affect your ability to participate

  • Require medication or special accommodations

  • Pose a risk to yourself or others

9.4 Pregnancy

If you are pregnant, please consult your doctor before booking. Our Trips involve alcohol, certain foods (cheeses, cured meats), physical activity, and travel that may not be suitable during pregnancy.

9.5 Medications

You are responsible for bringing sufficient medications for the duration of the Trip. We are not responsible if you run out of or forget your medications.

10. SWIMMING POOL

The stanzia accommodation includes an outdoor, non-heated swimming pool. Please note:

⚠️ USE AT YOUR OWN RISK

  • No lifeguard is on duty

  • Do not swim alone

  • Do not swim while intoxicated

  • Children must be supervised at all times

  • We are not liable for drowning, injuries, or accidents related to pool use

Pool rules will be provided upon arrival. Failure to follow pool rules may result in removal from the Trip without refund.

11. TRAVEL INSURANCE - STRONGLY RECOMMENDED

WE STRONGLY RECOMMEND THAT ALL PARTICIPANTS PURCHASE COMPREHENSIVE TRAVEL INSURANCE.

Your insurance should cover:

  • Trip cancellation and interruption

  • Medical expenses and emergency evacuation

  • Lost or delayed baggage

  • Personal liability

  • Accidents and injuries

Sip Sip Getaway is not responsible for any medical expenses, emergency evacuation costs, or other losses that would be covered by travel insurance.

12. TRAVEL DOCUMENTS

12.1 Your Responsibility

You are solely responsible for ensuring you have valid travel documents, including:

  • Valid passport (if traveling from outside the EU/Schengen Area)

  • Valid national ID card (if EU citizen)

  • Visa (if required for your nationality)

  • Any health certificates or vaccination records required for entry to Croatia

12.2 Visa Requirements

Check with the Croatian embassy or consulate in your country for visa requirements. We are not responsible if you are denied entry to Croatia due to improper documentation.

13. ASSUMPTION OF RISK & LIMITATION OF LIABILITY

13.1 Assumption of Risk

By participating in our Trips, you acknowledge and accept the inherent risks, including but not limited to:

  • Alcohol consumption and intoxication

  • Food allergies and dietary reactions

  • Swimming pool use (drowning, injury)

  • Ground transportation (accidents)

  • Walking on uneven terrain (trips, falls)

  • Travel to and within Croatia (crime, political instability, natural disasters)

  • COVID-19 or other communicable diseases

  • Actions or omissions of third-party service providers

YOU VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH PARTICIPATION IN THE TRIP.

13.2 Release of Liability

To the fullest extent permitted by law, you agree to release and hold harmless Sip Sip Getaway, Tegelfabriek, and their owners, employees, agents, and representatives from any and all liability for:

  • Personal injury, illness, or death

  • Property damage or loss

  • Emotional distress

  • Financial loss

EXCEPT where caused by our gross negligence or willful misconduct.

13.3 Limitation of Liability

Our maximum liability to you for any claim shall not exceed the total amount you paid for the Trip.

We are not liable for:

  • Acts or omissions of third-party service providers (wineries, restaurants, accommodation, transport)

  • Force majeure events (Section 7)

  • Your failure to follow instructions or safety guidelines

  • Pre-existing medical conditions

  • Losses that could have been covered by travel insurance

13.4 EU Consumer Rights

Nothing in these Terms limits your statutory rights under EU consumer protection laws, including rights that cannot be waived by contract.

14. THIRD-PARTY SERVICE PROVIDERS

We use third-party vendors including:

  • Accommodation providers (stanzia)

  • Wineries

  • Restaurants

  • Olive oil producers

  • Transportation services (taxis, rental cars)

While we use reasonable care in selecting these providers:

  • We do not control their operations

  • We are not responsible for their acts or omissions

  • You agree that any claims related to third-party services should be directed to those providers

15. TRAVEL TO/FROM CROATIA

15.1 Flights

Airfare is NOT included. You are responsible for:

  • Booking your own flights

  • Arriving on time for airport pickup

  • Flight delays or cancellations

15.2 Airport Transfers

We provide pickup from and drop-off to the agreed airport on designated dates and times as additional services. If you miss your pickup or need transfer from a different airport, additional fees may apply.

15.3 Late Arrival / Early Departure

If you arrive late or depart early and miss included activities or meals, no refund or credit will be issued.

16. PARTICIPANT CONDUCT & BEHAVIOR

16.1 Code of Conduct

All participants are expected to:

  • Treat other guests, staff, and locals with respect

  • Follow instructions from Sip Sip Getaway staff

  • Respect the property of the stanzia, wineries, restaurants, and other venues

  • Comply with Croatian laws and customs

  • Not engage in illegal activities

16.2 Prohibited Behavior

We have zero tolerance for:

  • Harassment, discrimination, or hate speech

  • Violence or threats of violence

  • Illegal drug use

  • Sexual misconduct

  • Theft or vandalism

  • Excessive intoxication

16.3 Right to Remove Participants

We reserve the right to immediately remove any participant from the Trip, without refund, if:

  • They violate this Code of Conduct

  • They endanger themselves or others

  • They damage property

  • They are disruptive to other guests' enjoyment

Removed participants are responsible for their own return transportation and any associated costs.

16.4 Damage to Property

You are financially responsible for any damage you cause to property, including the stanzia, rental vehicles, or third-party venues. We may charge your payment method or pursue legal action to recover costs.

17. COMPLAINTS & DISPUTE RESOLUTION

17.1 During the Trip

If you have a complaint during the Trip, please notify our staff immediately so we can attempt to resolve it in real-time.

17.2 After the Trip

If you wish to make a formal complaint after the Trip, you must submit it in writing to hello@sipsipgetaway.com within 30 days of the Trip's end.

We will acknowledge your complaint within 7 days and provide a substantive response within 30 days.

17.3 Mediation

Before initiating legal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation or mediation.

18. PHOTOGRAPHY, VIDEO & SOCIAL MEDIA

18.1 Our Use of Photos/Videos

During the Trip, Sip Sip Getaway staff may take photographs and videos for marketing purposes (website, social media, promotional materials).

By participating, you grant us permission to use your likeness in such materials unless you opt out in writing at the time of booking.

18.2 Your Use of Photos/Videos

You may take photos and videos for personal use. However:

  • Please be respectful of other participants' privacy

  • Some venues may prohibit photography

  • Do not use photos/videos for commercial purposes without our written permission

18.3 Social Media

We encourage you to share your experience on social media! Please tag us at @sipsip_getaway.

However, please do not post content that:

  • Violates other participants' privacy

  • Disparages Sip Sip Getaway, staff, or venues

  • Contains false or misleading information

19. DATA PROTECTION & PRIVACY

We collect and process your personal data in accordance with the EU General Data Protection Regulation (GDPR) and Dutch data protection laws.

19.1 What Data We Collect

  • Contact information (name, email, phone)

  • Payment information

  • Dietary restrictions and food allergies

  • Emergency contact information

  • Health information (if voluntarily disclosed)

19.2 How We Use Your Data

  • To process your booking and provide services

  • To communicate with you about your Trip

  • To ensure your safety and accommodate your needs

  • For marketing (only with your consent)

19.3 Data Sharing

We share your information only with:

  • Third-party service providers (accommodation, wineries, restaurants, transport) as necessary to fulfill your booking

  • Legal authorities if required by law

19.4 Your Rights

Under GDPR, you have the right to:

  • Access your data

  • Correct inaccurate data

  • Request deletion (subject to legal obligations)

  • Object to processing

  • Data portability

20. INTELLECTUAL PROPERTY

All content on sipsipgetaway.com, including text, graphics, logos, images, and software, is the property of Bamboe Services/Sip Sip Getaway or our licensors.

You may not:

  • Copy, reproduce, or distribute our content without written permission

  • Use our trademarks or branding

  • Scrape or data-mine our website

21. GENERAL LEGAL TERMS

21.1 Entire Agreement

These Terms, together with our Privacy Policy and any booking confirmation, constitute the entire agreement between you and Sip Sip Getaway.

21.2 Amendments

We may update these Terms from time to time. The latest version will be posted on our website with the revision date. Your continued use of our services after changes constitutes acceptance.

For bookings already confirmed, the Terms in effect at the time of booking will apply.

21.3 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full effect.

21.4 Waiver

Our failure to enforce any provision does not constitute a waiver of that provision or any other.

21.5 No Assignment

You may not transfer or assign your rights or obligations under these Terms without our written consent (except for booking transfers as permitted in Section 5.5).

21.6 Language

These Terms are provided in English. In case of any translation, the English version prevails.

22. GOVERNING LAW & JURISDICTION

22.1 Governing Law

These Terms are governed by the laws of the Netherlands.

However, your Trip takes place in Croatia and is also subject to Croatian tourism regulations and laws.

22.2 Jurisdiction

Any disputes shall be subject to the exclusive jurisdiction of the courts of the Netherlands, except where EU consumer protection laws provide you with mandatory jurisdiction in your country of residence.

23.2 During the Trip

A Sip Sip Getaway staff member will be available 24/7 during your Trip for emergencies.

Emergency contact information will be provided in your pre-trip information packet.

23.3 Medical Emergencies

In case of medical emergency:

  1. Call 112 (EU emergency number)

  2. Notify Sip Sip Getaway staff immediately

  3. Contact your travel insurance provider

We are not responsible for medical expenses - this is why travel insurance is essential.
